Terms of Service
Last updated: 13 August 2026
Overview
Welcome to The House of Names. The terms “we”, “us” and “our” refer to The House of Names.
We operate this online store and website, including its content, features, products and related services. Our online store is powered by Shopify.
These Terms of Service govern your access to and use of our website and your purchase of products from us. By accessing our website or placing an order, you agree to these Terms, our Privacy Policy, Returns and Refund Policy, Shipping Policy and any other policies displayed on our website.
If you do not agree to these Terms, please do not use our website or services.
Nothing in these Terms is intended to exclude or limit any rights that cannot lawfully be excluded under the Consumer Protection Act 68 of 2008, the Electronic Communications and Transactions Act 25 of 2002, or other applicable South African legislation.
1. Eligibility and Accounts
You must be at least 18 years old or have the permission and supervision of a parent or legal guardian to place an order.
When creating an account or placing an order, you agree to provide accurate, current and complete information.
You are responsible for:
-
Protecting your account password;
-
Restricting access to your account;
-
Ensuring that the information associated with your account remains accurate; and
-
Notifying us if you suspect unauthorised access to your account.
We may suspend or restrict an account where we reasonably suspect fraudulent, unlawful or unauthorised activity.
2. Products
We make reasonable efforts to display our products, colours, embroidery and designs accurately. However, colours and appearance may vary slightly depending on:
-
Your screen and device settings;
-
Lighting used in product photographs;
-
Fabric texture and composition;
-
Available garment batches; and
-
Natural variations in embroidery thread and production.
Minor variations that do not materially affect the product’s quality or agreed design will not necessarily constitute a defect.
Product descriptions, designs, sizes, prices and availability may be updated from time to time. Changes will not affect orders already accepted unless agreed with the customer or reasonably necessary because of circumstances outside our control.
3. Personalised Products
Many of our sweaters, shirts and caps are custom-made or embroidered according to information provided by the customer.
Customers are responsible for checking all personalisation details before submitting an order, including:
-
Names and surnames;
-
Dates and established years;
-
Spelling and punctuation;
-
Capitalisation;
-
Garment type;
-
Garment size;
-
Garment and embroidery colours;
-
Font or design selection; and
-
Any other custom instructions.
We will generally produce the item according to the information submitted with the order or subsequently approved by the customer.
Where a preview or proof is supplied, production may only begin after approval. The customer’s approval confirms that the spelling, layout and other displayed details are correct.
We are not responsible for an error that appears exactly as entered or approved by the customer. This does not affect the customer’s rights where we make an error, supply the wrong product or fail to follow the confirmed order.
4. Permission to Use Names and Designs
By submitting a name, surname, phrase, logo, image or design, you confirm that:
-
You are entitled to use it;
-
Its use will not unlawfully infringe another person’s intellectual-property, privacy or other rights; and
-
You have permission to provide any personal information belonging to another person.
We may refuse a customisation request that we reasonably believe is unlawful, threatening, hateful, discriminatory, defamatory, obscene, misleading or infringes another person’s rights.
We may also refuse to reproduce protected logos, characters, artwork or trademarks where the customer cannot demonstrate permission to use them.
5. Orders and Acceptance
Submitting an order constitutes an offer to purchase the selected products.
An automated order confirmation acknowledges receipt of the order but does not necessarily mean that the order has been accepted. An order is accepted once payment has been successfully processed and we confirm that it can be fulfilled.
We may reject or cancel an order where:
-
Payment cannot be verified;
-
The product or selected material is unavailable;
-
There is an obvious pricing or product-description error;
-
We reasonably suspect fraud or unlawful activity;
-
The requested design infringes another person’s rights; or
-
We cannot reasonably complete the customisation requested.
If we cancel an order after receiving payment, we will refund the affected amount using the original payment method.
6. Changes and Cancellations
Personalised orders may enter production shortly after payment or design approval.
Requests to change or cancel an order must be sent to support@thehouseofnames.co.za as soon as possible.
We cannot guarantee that a change or cancellation will be possible after:
-
Embroidery or printing has begun;
-
A garment has been altered;
-
Materials have been ordered specifically for the customer; or
-
The order has been handed to the courier.
Any approved change may affect the price and production time. The customer will be informed before additional charges are applied.
Any cancellation or cooling-off right will remain subject to applicable South African law and the lawful exceptions that apply to goods made to a customer’s specifications or clearly personalised.
7. Pricing and Payment
Unless stated otherwise:
-
Prices are displayed in South African rand;
-
The applicable product price is the price displayed when the order is submitted;
-
Delivery charges are calculated or displayed during checkout; and
-
Any applicable taxes will be included or disclosed as required by law.
We may change prices at any time, but changes will not affect accepted orders.
The customer must provide complete and accurate billing information and confirm that they are authorised to use the selected payment method.
Promotional offers may be subject to separate conditions, expiry dates and availability limits. Promotions cannot be combined unless we expressly state otherwise.
8. Obvious Pricing Errors
Although we take reasonable care, an obvious pricing or product-information error may occasionally occur.
If an error affects an order, we will contact the customer and provide the option to:
-
Continue at the correct price;
-
Select a suitable alternative; or
-
Cancel the affected product for a refund.
We will not alter an accepted order without informing the customer.
9. Production Times
Personalised items require production time before dispatch.
Any production time displayed on our website or communicated to the customer is an estimate. Production may take longer during busy periods, promotions, holidays, supplier delays or unusually large orders.
If a material delay occurs, we will take reasonable steps to notify the customer and provide an updated estimate.
10. Shipping and Delivery
Delivery times are estimates and may be affected by courier delays, weather, service interruptions, remote delivery areas or circumstances outside our reasonable control.
Customers must provide a complete and accurate delivery address. Additional delivery costs resulting from an incorrect or incomplete address supplied by the customer may be charged to the customer where reasonable.
Customers should notify us promptly if an order:
-
Arrives damaged;
-
Contains the incorrect product;
-
Appears to be missing an item; or
-
Has not arrived within a reasonable period after the estimated delivery date.
Delivery and risk will be handled in accordance with applicable South African consumer law and our Shipping Policy.
11. Returns, Exchanges and Refunds
Returns, exchanges and refunds are governed by our Returns and Refund Policy and applicable South African law.
Because personalised products are made according to customer-selected details, they generally cannot be returned for a change of mind, an incorrectly selected size or incorrect information supplied or approved by the customer.
This does not affect the customer’s rights where a product is defective, damaged, incorrectly supplied or not produced according to the confirmed order.
12. Product Care
Customers must follow the care instructions supplied with the garment or displayed on our website.
Damage resulting from incorrect washing, bleaching, excessive heat, tumble-drying contrary to care instructions, misuse, alterations, accidents or normal wear and tear may not constitute a product defect.
13. Intellectual Property
Unless otherwise stated, the website and its original content—including The House of Names branding, logos, photographs, graphics, product designs, text and layout—belong to us or are used under licence.
You may use the website for personal, lawful and non-commercial shopping purposes.
Without prior written permission, you may not:
-
Copy or commercially exploit our content;
-
Republish our product photographs;
-
Use our name or logo in a misleading manner;
-
Reproduce our original designs for commercial sale;
-
Remove intellectual-property notices; or
-
Suggest that we endorse another business or product.
Third-party trademarks and content remain the property of their respective owners.
14. Reviews and Customer Content
If you submit a review, photograph, comment or other content, you confirm that:
-
The content is truthful and based on your genuine experience;
-
You have the right to submit it;
-
It does not infringe another person’s rights;
-
It does not contain unlawful, abusive or misleading material; and
-
It does not contain malicious software or harmful code.
You grant us permission to display and reproduce voluntarily submitted reviews and related content for operating and promoting our store, subject to applicable privacy and consumer laws.
We will not knowingly publish a personalised product photograph showing a customer’s private information for advertising without permission where permission is required.
We may moderate or remove content that violates these Terms or applicable law.
15. Acceptable Use
You may not use our website:
-
For unlawful, fraudulent or malicious purposes;
-
To infringe intellectual-property or privacy rights;
-
To upload harmful code or interfere with website security;
-
To impersonate another person;
-
To collect other users’ personal information without permission;
-
To send spam or unauthorised marketing;
-
To submit false or misleading information; or
-
To scrape, copy or exploit our website contrary to applicable law.
We may reasonably restrict access where these Terms are violated.
16. Third-Party Services and Links
Our website may contain links to or integrations with services operated by third parties, such as payment providers, couriers and social-media platforms.
Those services may be governed by separate terms and privacy policies. We are not responsible for third-party websites or services outside our reasonable control.
17. Shopify
Our store is powered by Shopify, which supplies the ecommerce platform through which we offer our products.
Purchases are made directly from The House of Names. Shopify is not the seller of our products and is not responsible for fulfilling orders or resolving product-related concerns.
Certain information will be processed by Shopify as explained in our Privacy Policy and Shopify’s applicable privacy notices.
18. Privacy
Personal information is collected and processed according to our Privacy Policy and applicable South African privacy legislation, including POPIA.
Our Privacy Policy explains what information we collect, why we use it, when it may be shared and how customers may exercise their privacy rights.
19. Availability of the Website
We aim to keep our website secure and available, but we cannot guarantee uninterrupted or error-free operation.
We may temporarily suspend or restrict access for maintenance, security, updates or circumstances outside our reasonable control.
20. Consumer Guarantees
Products supplied by us are subject to all warranties, guarantees and remedies that apply under South African consumer law.
Nothing in these Terms excludes liability or customer rights that cannot lawfully be excluded, including rights relating to unsafe, defective, poor-quality or incorrectly supplied products.
21. Limitation of Liability
To the fullest extent permitted by applicable law, we will not be liable for indirect or consequential losses that were not reasonably foreseeable when the order was placed.
We are not responsible for loss or damage caused by:
-
Incorrect information supplied or approved by the customer;
-
Misuse or improper care of a product;
-
Unauthorised alterations made after delivery;
-
Use of customer-submitted content that the customer was not entitled to provide; or
-
Events outside our reasonable control.
Nothing in this section excludes or limits liability where doing so would be prohibited by South African law.
22. Indemnity
To the extent permitted by law, you agree to be responsible for losses or claims reasonably arising from:
-
Your unlawful use of our website;
-
Your material breach of these Terms;
-
Your infringement of another person’s intellectual-property or privacy rights; or
-
Content or personalisation instructions you submit without the necessary permission.
This section does not require a consumer to indemnify us for our own unlawful conduct, negligence or breach of applicable consumer law.
23. Termination
You may stop using our website at any time.
We may suspend or terminate access where a user materially violates these Terms, threatens website security, commits fraud or uses our services unlawfully.
Termination will not affect rights, payment obligations or accepted orders that arose before termination, unless the affected order is lawfully cancelled and refunded.
24. Severability
If any provision of these Terms is found to be unlawful or unenforceable, that provision will be limited or removed only to the extent necessary. The remaining provisions will continue to apply.
25. No Waiver
A delay or failure to enforce a provision of these Terms does not constitute a waiver of that provision or any other right.
26. Entire Agreement
These Terms and the policies referenced in them form the agreement governing your use of our website and purchases from us.
If a specific promotion or written agreement contains terms that conflict with these Terms, the more specific terms will apply to that promotion or agreement to the extent of the conflict.
27. Governing Law
These Terms and purchases made through our store are governed by the laws of the Republic of South Africa.
Any dispute will be dealt with by a South African court or other competent consumer body with jurisdiction, subject to any rights available to the customer under applicable law.
28. Changes to These Terms
We may update these Terms to reflect changes to our products, services, operations or legal obligations.
The updated version will be published on our website with a revised “Last updated” date. Changes will not unlawfully remove rights relating to an order already accepted.
